had my tribunal yesterday 3 people in the panel doctor asked me to relate back to how i felt nov 2009 when i made my appeal not how i felt now. doctor asked from where you are sitting can you tell me where 800 meters is , i couldnt, ne then said i had stated on form i coudnt walk more than this before stopping, how did i know 8oo mitres then and not now, i explained my friend walked with me and she said it was about that, doctor said you are not very good with distences are you. i knew then appeal was not going in my faver i had man from CAB with me and he said i was the 6 person to be turned down that day, do you have to be housebound and need 24hr care before getting this lower rate DLA i will not appeal again i wont put myself through this again for £17. 50 a week would like to know if anyone else has been through this it is very nerve racking they make you feel like a fraud i have waited 10 months for this and it was over in 20 mins soz for going on but had to get it of my chest sylvia xx

Hi Sylvia So sorry to hear of the emotional trauma this has put you through. I understand how you must be feeling as I went to a tribunal many years ago and felt as though I was under some sort of cross examination for a serious criminal offence! Unfortunately, this I'm sure is due in no small part to the number of 'fraudsters' exploiting the system which in turn makes it very difficult for those of us who are in genuine need. I got DLA in the end, but it wasn't easy. The criteria are fairly set in stone but I would have thought CAB would have been able to advise you more about what to expect and how to respond. Lowest rate If you need help or supervision for some of the day or you are unable to prepare a cooked main meal. Middle rate If you need help with personal care frequently or supervision continually throughout the day only, or help with personal care or someone to watch over you during the night only, or someone with you while you are on dialysis. Highest rate If you need help or supervision frequently throughout the day and during the night.
You can get Disability Living Allowance for your care needs even if no one is actually giving you the care you need, even if you live alone. Have you looked at the NRAS Benefits Guide? The cutbacks aren't helping but if you meet the criteria you should not be made to feel that you are 'using' the system. I understand your wish not to go through that again but £17.50 a week, £910 a year, is a lot of money when it comes to getting a bit of help with things (even if you just treat yourself to some useful gadgetry around the house!) It is a shock to the system to be put in this sort of situation. I would be tempted to write and complain if you decide not to appeal. The stress this has caused could easily lead to a flare of the RA. NUMPTIES Lyn x

hi,sorry to add insult to injury but i got low dla this year and on first try,my son has gone part time and helps me at home and getting about when im bad, i feel its like going for a driving test they only pass a certain amount, at present i am waiting to hear if i have got a blue badge or not,my consultant suggested i try for it so ill let you know, it is very dissheartening i know, they seam to kick us when were down.i have the same view that dla and badges are so misstreated that the really needy genuine people do suffer,good luck take care.

Hello you poor thing,
It is dreadful when they make you feel such a fraud. It is not right. Like Lynn says they shouldn.t get away with it it is all soo wrong. It makes you feel like your a criminal.
I have recieved the paper work for DLA myself now and I am hoping that I may be eligible for perhaps the lowest level. It is a huge form to complete this time next week may finish it - but as you say what for ? to turn me down
Chin up and send that letter as Lynn suggests

Hi all, it makes my blood boil when you think of all the people fraudulently claiming and living the high life! I was turned down this summer but have asked for a reconsideration, still waiting to hear. Im not asking for the moon, just as you all said something to help!
Rose, when you complete the forms, complete them as though it is your worst day, thats the mistake I made!

Hi all! That's a really valid point Heather. We all like to convince others (and ourselves!) that we are not actually quite as bad as we are and it can become quite a habit. It's so easy when filling in forms to think oh yes I can manage to peel potatoes, I can lift up the kettle and fill it with water, I can flush the loo etc... When in actual fact I might manage said tasks with difficulty once a week (except peeling spuds!!). You really do have to think of the worse day scenario. That is the reality for many of us and those are the criteria upon which decisions should be made. On the other hand if you are able to do these types of things, albeit with some discomfort, day in day out then you probably wouldn't meet the criteria to claim! Be realistic and honest with yourself  . Lyn x

thanks to all for replys my grandaughter who is 19 calls in in the morning to help me get up and dressed my daughter adds me in when cooking for family as i dropped pot of hot water i told them this and answered all qeuste ns truthfully really dont know what else i could have done except mybe told lies i wont go down that road as wouldnt remember what i said. sylvia x

i agree with everyone when i filled in the endless form i was on bad days and felt really down, i also kept a list of hard things for reference,i really hope you have luck next time,i had a medical assesment recently and after over an hour in the car just to get there i was in a bad way, lucky for me my son takes me on long drives as i have to get him to haul me out again and get me upright,good job he is a body builder for fun,i hate the way i get treated and looked at and i am only starting with all this so good luck sylvia. ps did get new benefit after all the effort and embarassment got letter today.stick with it.

Hi, so sorry to hear you didn't get DLA, I had my tribunal in August which went back to Nov 09 claim, I took a CAB official with me and my daughter too. The questions were asked in an abrupt and condescending manner by the spokesperson who was sat in the middle and as the interview went on I was getting more and more angry and frustrated, he too asked me how far I thought the building across the road was, replying that I didn't know, he told me it was 50 metres away and did I think I could walk that far, I said yes with difficulty and straight back at me came the question if you have difficulty walking that far how did I get from the main entrance of the hospital to the Muscular skeletal dept for treatment because that was twice the length. I just saw red and said "ok thats enough of me grovelling to you all, dont give it me, give it to all the ones who claim they cant move and then go out dancing all weekend or shopping till they drop on state handouts for imaginary illnesses, just read my doctors letters and reports its all in there what i have wrong with me, I would crawl over broken glass to get help to take even a bit of pain away so thats how I get to the dept,why would I put myself through all this if I didn't have something wrong with me" and then I burst into tears just through the stress of it all, we were sent out to wait for the verdict and called back within 10 minutes, I got lower rate care and full rate mobility, guess I gave as good as I got, They are just a bunch of people who look down on you but I am as good as they are. What I am trying to say to you is dont give up, fight back, they expect people to crumble in those interviews, if you got it the difference that DLA payment makes is an eye opener, if you get that you can get other things too which you aren't considered eligible for unless you get DLA. I haven't read too many posts on here being a newbie so dont know your circumstances but I hope you do try again to claim. Regards Eileen x
